Teary (천연눈물) 서비스 이용약관

제1조 (목적)

본 약관은 MinApps(이하 "회사")가 제공하는 Teary(천연눈물) 애플리케이션(이하 "서비스")의 이용에 관한 회사와 이용자 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제2조 (정의)

1. "서비스"란 회사가 제공하는 Teary(천연눈물) 모바일 애플리케이션 및 관련 서비스를 말합니다.
2. "이용자"란 본 약관에 동의하고 서비스를 이용하는 자를 말합니다.
3. "콘텐츠"란 서비스를 통해 제공되는 YouTube 동영상 및 관련 정보를 말합니다.

제3조 (서비스의 내용)

1. 서비스는 감성적인 YouTube 동영상을 재생하여 자연스러운 눈물 분비를 유도함으로써 안구건조증 케어를 돕는 애플리케이션입니다.
2. 서비스는 무료로 제공되며, 별도의 인앱 구매 항목은 없습니다.
3. 이용자는 YouTube 링크를 자신의 라이브러리에 추가하여 개인적으로 활용할 수 있습니다.

제4조 (약관의 효력 및 변경)

1. 본 약관은 서비스 내 공지 또는 기타 적절한 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
2. 회사는 관련 법령에 위배되지 않는 범위 내에서 본 약관을 변경할 수 있으며, 변경 시 적용일자 및 변경사유를 명시하여 최소 7일 전에 공지합니다.
3. 이용자가 변경된 약관의 적용일 이후에도 서비스를 계속 이용하는 경우 변경된 약관에 동의한 것으로 봅니다.

제5조 (이용자의 의무)

이용자는 다음 각 호의 행위를 하여서는 안 됩니다.

1. 서비스를 이용하여 법령 또는 공서양속에 위반되는 행위
2. 타인의 권리를 침해하거나 타인에게 불이익을 주는 행위
3. 서비스의 정상적인 운영을 방해하는 행위
4. 서비스를 상업적 목적으로 무단 이용하는 행위
5. 저작권 등 지적재산권을 침해하는 콘텐츠를 등록하는 행위
6. 서비스의 기술적 보호조치를 우회하거나 무력화하는 행위

제6조 (지적재산권)

1. 서비스를 통해 재생되는 YouTube 동영상의 저작권은 해당 콘텐츠의 원저작자에게 있습니다.
2. 서비스는 YouTube API 서비스를 통해 콘텐츠를 제공하며, 이용자는 YouTube 서비스 약관 및 Google 개인정보처리방침에도 동의하는 것으로 간주됩니다.
3. 서비스의 애플리케이션 자체(디자인, 코드, 상표 등)에 대한 지적재산권은 회사에 귀속됩니다.
4. 이용자가 라이브러리에 추가한 YouTube 링크에 대해 회사는 어떠한 소유권도 주장하지 않습니다.

제7조 (의료 관련 면책)

1. 서비스는 의료기기가 아니며, 의학적 진단, 치료 또는 예방을 목적으로 하지 않습니다.
2. 서비스를 통해 제공되는 어떠한 정보도 의학적 조언으로 해석되어서는 안 됩니다.
3. 안구건조증 또는 기타 안과 질환이 있는 경우 반드시 의료 전문가의 진료를 받으시기 바랍니다.
4. 서비스 이용으로 인한 건강상의 결과에 대해 회사는 책임을 지지 않습니다.

제8조 (면책조항 및 책임의 제한)

1. 회사는 천재지변, 전쟁, 기간통신사업자의 서비스 중단 등 불가항력적 사유로 서비스를 제공할 수 없는 경우 책임이 면제됩니다.
2. 회사는 이용자의 귀책사유로 인한 서비스 이용 장애에 대해 책임을 지지 않습니다.
3. 회사는 제3자(YouTube 등)가 제공하는 콘텐츠의 정확성, 신뢰성, 적법성에 대해 보증하지 않습니다.
4. 서비스는 "있는 그대로(as-is)" 제공되며, 회사는 서비스의 특정 목적에의 적합성, 정확성, 완전성에 대해 명시적 또는 묵시적 보증을 하지 않습니다.
5. 회사의 책임은 관련 법령이 허용하는 최대 범위 내에서 제한됩니다.

제9조 (서비스의 변경 및 중단)

1. 회사는 운영상, 기술상의 필요에 따라 서비스의 전부 또는 일부를 변경하거나 중단할 수 있습니다.
2. 서비스 변경 또는 중단 시 회사는 이용자에게 사전에 공지합니다. 다만, 불가피한 사유가 있는 경우 사후에 공지할 수 있습니다.
3. 무료로 제공되는 서비스의 변경 또는 중단에 대해 회사는 별도의 보상 의무를 지지 않습니다.

제10조 (이용계약의 해지 및 서비스 이용 제한)

1. 이용자는 언제든지 서비스 이용을 중단하고 애플리케이션을 삭제함으로써 이용계약을 해지할 수 있습니다.
2. 회사는 이용자가 본 약관을 위반한 경우 사전 통보 없이 서비스 이용을 제한하거나 이용계약을 해지할 수 있습니다.

제11조 (개인정보보호)

이용자의 개인정보 수집, 이용, 보호에 관한 사항은 별도의 개인정보처리방침에 따릅니다.

제12조 (준거법 및 분쟁해결)

1. 본 약관의 해석 및 서비스 이용에 관한 분쟁은 대한민국 법률을 준거법으로 합니다.
2. 서비스 이용과 관련하여 분쟁이 발생한 경우, 회사와 이용자는 원만한 해결을 위해 성실히 협의합니다.
3. 협의로 해결되지 않는 분쟁에 대해서는 민사소송법에 따른 관할 법원에 소를 제기할 수 있습니다.

본 약관은 2026년 3월 22일부터 시행합니다.

These Terms of Service ("Terms") govern your use of the Teary application ("Service") provided by MinApps ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Service Description

1. Teary is a mobile application that plays emotional YouTube videos to induce natural tear secretion for dry eye care.
2. The Service is provided free of charge with no in-app purchases.
3. Users may add YouTube links to their personal library for individual use.

3. User Responsibilities

You agree not to:

1. Use the Service in violation of any applicable laws or regulations;
2. Infringe upon the rights of others or cause harm to other users;
3. Interfere with the normal operation of the Service;
4. Use the Service for unauthorized commercial purposes;
5. Upload or register content that infringes intellectual property rights;
6. Circumvent or disable any technical protection measures of the Service.

4. Intellectual Property

1. All YouTube videos played through the Service are the property of their respective original creators. We do not claim ownership of any third-party content.
2. The Service utilizes YouTube API Services. By using the Service, you also agree to the YouTube Terms of Service and the Google Privacy Policy.
3. The intellectual property rights in the application itself (design, code, trademarks, etc.) belong to the Company.
4. We do not claim any ownership over YouTube links that users add to their libraries.

5. Medical Disclaimer

1. The Service is not a medical device and is not intended for medical diagnosis, treatment, or prevention of any condition.
2. No information provided through the Service should be construed as medical advice.
3. If you have dry eye syndrome or any other eye condition, please seek professional medical care.
4. The Company is not responsible for any health outcomes resulting from the use of the Service.

6. Disclaimers and Limitation of Liability

1. The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. The Company does not guarantee the accuracy, reliability, or legality of third-party content (including YouTube videos) accessible through the Service.
3. To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
4. The Company is not liable for service interruptions caused by force majeure, including but not limited to natural disasters, network outages, or third-party service disruptions.

7. Changes to the Service

1. We may modify or discontinue the Service (in whole or in part) at any time for operational or technical reasons.
2. We will provide advance notice of material changes when practicable. In unavoidable circumstances, notice may be provided after the fact.
3. No compensation is owed for changes or discontinuation of the free Service.

8. Termination

1. You may terminate your use of the Service at any time by uninstalling the application.
2. We may restrict your access to or terminate your use of the Service without prior notice if you violate these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the Service at least 7 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

10. Privacy

Our collection, use, and protection of your personal information is governed by our separate Privacy Policy.

11. Governing Law and Dispute Resolution

1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
2. Any disputes arising from the use of the Service shall first be resolved through good-faith negotiation between the parties.
3. If negotiation fails, disputes shall be submitted to the competent court under the Civil Procedure Act of the Republic of Korea.

Supplementary Provision

These Terms are effective as of March 22, 2026.
